1TO1Mobile ltd. (“1TO1Mobile,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy explains how 1TO1Mobile collects, uses, discloses, and secures (“processes”) information about individuals that constitutes personal information under applicable data protection and privacy laws in Kenya (hereinafter, “Personal Information”) through www.1to1mobile.co.ke (“Website”), our computer or mobile applications, our electronic communications, including email and text messages, and other websites and services that we provide that are controlled by us and display this Privacy Policy (collectively, the “Service”).

1TO1Mobile’s Roles and Responsibilities

As a data controller or business, 1TO1Mobile is subject to this Privacy Policy with regards to processing Personal Information, controlling how and why it is processed. However, if 1TO1Mobile is acting as a data processor or service provider, such as on our Clients’ websites or applications, this Privacy Policy does not apply. In such cases, the website or application may have its own terms and privacy policies, and if you wish to exercise any rights you have under applicable data protection laws, please reach out to the Client directly. If your Personal Information was submitted to us by or on behalf of a Client, and you want to make a request, please provide us with the name of the Client. We will verify the Client and refer your request to them, supporting them in responding to your request within a reasonable timeframe. If you are an employee, officer, or agent of the Client, the use of your Personal Information may be subject to the agreement between 1TO1Mobile and the Client.

Personal Information We Collect

1TO1Mobile collects information from users of their Service in various ways, as a service provider for organizations (referred to as “Clients”) who want to interact with individual consumers (“Client Consumers”) through the Service. This includes collecting information from Client Consumers to deliver commercial text messages that can also be used for payments. In this capacity, 1TO1Mobile acts as a data processor.

1TO1Mobile also collects information from Clients, Client Consumers, and other individuals who visit their Website or use their Services. The information collected may include Personal Information that users provide, such as when they register to use the Service or contact customer service.

If users are employees, agents, or officers of a Client or use services controlled or managed by 1TO1Mobile (“1TO1Mobile Consumers”), the Personal Information collected may include the information provided when registering for and contracting to use the Service.

Clients may also provide 1TO1Mobile with information about their Consumer Clients, such as their name, email address, and telephone number. Clients are responsible for obtaining the necessary consents for 1TO1Mobile to process this Personal Information.

1TO1Mobile may automatically collect certain Personal Information through users’ browsers or devices, such as technical information associated with the device(s) used to access the Service, usage information to better understand the use of the Service, and transaction information to help verify transactions.

Additionally, 1TO1Mobile may collect Personal Information from social media and other content platforms when users follow or interact with them, and from third-party service providers, advertisers, business partners, and other third parties they work with. This information may be combined with other information received through the Service.

  • If you engage with a Client using our Services, we may share your Personal Information with that particular Client. We may also share your Personal Information with our affiliates, who are entities that control or are under the control of 1TO1Mobile, for business purposes. These entities must comply with the terms of this Privacy Policy regarding the use of your Personal Information.
  • We may disclose your Personal Information to state, federal, and international courts, regulatory and government authorities, public and government authorities outside your country of residence, or other parties when we believe it is necessary or appropriate to do so.
